PRAYER: Criminal Original Petition filed under Section 439 (1)(b) of Cr.P.C. praying to modify the (ii) condition imposed by the learned Principal Sessions Judge, Thoothukudi, in Cr.M.P.No.2518 of 2023 dated 28.04.2023.

ORDER

This petition has been filed to modify the condition imposed on the petitioner in Cr.M.P.No.2518 of 2023 dated 28.04.2023.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. Considering the facts and circumstances of the case, the condition already imposed on the petitioner is modified to the effect that the petitioner shall deposit a cash security of Rs.4,00,000/- (Rupees Four Lakhs only) before the learned Judicial Magistrate Court No.IV at Thoothukudi (the amount if deposited, shall be kept by the above Judicial Magistrate Court in Crl.C.D.a/c till the disposal of the case).

4. Accordingly, this Criminal Original Petition is allowed. 18.05.2023 NCC:Yes/No Index:Yes/No Sm Note: Issue Order Copy on 19.05.2023.
