ORDER

The petitioner, working as an Assistant Professor in the second respondent College, has filed this writ petition as against the instructions issued by the 1st respondent to the 2nd respondent in Na.Ka.No. 357/A2/2023 dated 25.04.2023. By the order impugned in this writ petition, the Joint Director of Collegiate Education, Thanjavur, directed the second respondent not to provide any increment to the petitioner that a criminal case has been registered against him.

The learned Additional Government Pleader opposed this writ petition that the impugned order is only an inter-departmental communication and the petitioner and four others have been appointed in the second respondent College, based on fake community certificates that they belong to Gandharvakottai Kallar community. However, according to him, they belong to Kallar community and they cannot be treated as Gandharvakottai Kallar community. However, certificates have been 2/6

obtained that they belong to Gandharvakottai Kallar community, based on which, they have been considered for that post, under de-notified category. He further submitted that a criminal case has been registered against the petitioner and others in Crime No.6 of 2022 on the file of the Vigilance and Anti-Corruption Department, Thanjavur.

3. Considering the rival submissions made, this Court called for an explanation as to the disciplinary proceedings initiated as against the petitioner and others, who have joined in the second respondent college with fake certificates.

4. However, today, when this writ petition is taken up for hearing, there is no representation for the second respondent.

The learned Additional Government Pleader, on written instructions, submits that the second respondent has initiated disciplinary proceedings as against the petitioner and four others, who are accused in Crime No.6 of 2022, under Section 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules and they have also been placed 3/6

under suspension by order dated 13.01.2026.

6. This Court considered the rival submissions made.

The allegation as against the petitioner is that he has obtained this appointment with fake certificate, for which, a criminal case has already been registered against him on the file of the Vigilance and AntiCorruption Department, in Crime No.6 of 2022 and a charge sheet has also been laid before the concerned Court on 17.07.2025. That apart, disciplinary proceedings has also been initiated as against the petitioner and he was placed under suspension, by order dated 13.01.2026. In these circumstances, the petitioner is not entitled for any increment.

8. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 04.02.2026 ogy Index : Yes / No.
