PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 6 to consider petitioner's representations dated 07.01.2025 and 25.02.2025, and to take appropriate action to remove the encroachment made by the 7th respondent in the public pathway in Natham Survey No.1307/18, Pillayar Kovil Street, Vannikonandal Village, Manoor Taluk, Tirunelveli District, to take action against the 7th Respondent for damaging the paver block road laid under the ''Anna Marumalarchi Thittam'' scheme; and to take action against the unauthorized construction made without approval and in violation of building norms.

The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 6 to consider the petitioner's representations dated 07.01.2025 and 25.02.2025, and to take appropriate action to remove the encroachment made by the 7th respondent in the 2/6

public pathway in Natham Survey No.1307/18, Pillayar Kovil Street, Vannikonandal Village, Manoor Taluk, Tirunelveli District, to take action against the 7th Respondent for damaging the paver block road laid under the ''Anna Marumalarchi Thittam'' scheme and to take action against the unauthorized construction made without approval and in violation of building norms.

Learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the official respondents will conduct survey and if there is any encroachment in the abovesaid survey number as alleged by the petitioner, the same will be removed by due process of law within a time frame.

Recording the said submission, the official respondents are directed to conduct survey and ascertain as to whether there is any encroachment in Natham Survey No.1307/18, Pillayar Kovil Street, Vannikonandal Village, Manoor Taluk, Tirunelveli District, by the 7th respondent as alleged by the petitioner. If so, such encroachment shall be removed by due process of law after affording opportunity to the 3/6

private respondent and all other parties concerned. Such an exercise shall be completed within a period of two months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No costs.
