ORDER
This Writ Petition is filed seeking Mandamus directing the second respondent not to interfere with the lawful day-to-day activities of the petitioner's Association.
2.According to the petitioner, he is the Secretary of Dindigul Star Fish Indoor Game Association Club, duly registered under the Societies Act, with an object to develop poor people education, knowledge and create Library, Sports equipments and entertainment sports. There are nearly 50 members in the said Society and they are conducting training for the children to participate in tournaments at the District level. They are actively serving their object since 12.11.2016. While so, on 23.02.2019, the Inspector of Police attached to Sempatti Police Station, entered into the Office premises and interfered in the recreation activities. W.P.(MD)No.9560 of 2019 Superintendent of Police on 12.04.2019, requesting him to intervene in the matter and issue necessary directions to the second respondent to desist from interfering with the lawful activities of the petitioner's Association.
3.The learned Government Advocate (Criminal side) submits that the petitioner is not residing in the address given in the affidavit and the address given in the affidavit, where the Association Office is alleged to be located, also does not carry any sports activities. In any case, if the petitioner is carrying on lawful activity, after due registration with the appropriate authorities, the respondent Police will not interfere in their lawful activity. It is also stated by the learned Government Advocate (Criminal side) that the allegation against the second respondent is false and imaginary, since the place where the petitioner claims to have their Association, does not fall within the territorial jurisdiction of the second respondent Police limit.
4.Recording the above said submission of the learned Government Advocate (Criminal side), this Writ Petition is dismissed. No costs.
