ORDER : The Court made the following order :- The petitioner/Accused No.2 apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c) and 20(b)(ii)(B) of NDPS Act, in Crime No.99 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on secret information when the respondent police went to inspect near Thirali Bus Stop on 15.04.2021 at about 12.00 hrs., the accused persons on seeing the police officials tried to flee away from the scene of occurrence. At that time, the police officials intercepted the accused and recovered 2 1⁄2 kgs. of Ganja. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is not involved in any activities as alleged by the respondent police. 4.The learned Additional Public Prosecutor submitted that this the third anticipatory bail application filed by the petitioner. The petitioner is accused No.2 and his mother was arrayed as accused No.1. On seeing the police officials, they tried to escape from the scene of occurrence. Accused No.1 was arrested and the contraband was also seized from her. There are materials to connect this petitioner to the occurrence. The petitioner is none other than the son of the first accused, from whom the contraband was recovered. This petitioner is also having three previous cases against him, which are similar in nature.

5.Considering the nature of allegations levelled against the petitioner and since the petitioner is having three previous cases against him, this Court is not inclined to grant anticipatory bail to the petitioner.
