To Condone the delay of 150 days in filing the above Civil Miscellaneous Appeal against the award passed in MCOP No.190 of 2012 dated 21.08.2012 on the file of the Motor Accident Claims Tribunal, Additional District & Sessions Judge, Pudukkottai PRAYER IN CMA(MD) No.SR21117 of 2013 To set aside the judgment and decree passed by the Motor Accident Claims Tribunal, Additional District and Sessions Judge, Pudukottai in MCOP No. 190 of 2012, dated 21.08.2012. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.D.SIVARAMAN, Advocate for the petitioner, the court made the following order:- This petition has been filed by the petitioner/Transport Corporation seeking permission of this Court to order service of notice on the sole respondent in C.M.P.(MD) No. 11389 of 2016 in https://hcservices.ecourts.gov.in/hcservices/
C.M.A.(MD) No.SR21117 of 2013 by means of substituted service.
2. Considering the reasons stated in the affidavit filed in support of the petition, the petitioner/Transport Corporation is permitted to serve notice to the respondent through substituted service by effecting paper publication in any one of the Tamil Daily newspaper which is having wide circulation in the locality, by duly indicating the date of next hearing as 19.12.2018.
3. The said exercise shall be completed on or before 11.12.2018 and the proof of paper publication should be filed before the Registry.
4. This petition is accordingly ordered.
5. The Registry is directed to post the delay petition on 19.12.2018.
