Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent to file Final Report in Cr.No.7 of 2020, dated 07.01.2020 under the supervision of the first respondent within a stipulated time frame fixed by this Court.

ORDER

This petition has been filed to direct the third respondent to file Final Report in Cr.No.7 of 2020, dated 07.01.2020 under the supervision of the first respondent within a stipulated time frame fixed by this Court.

2.The petitioner is the defacto complainant in Crime No.7 of 2020, on the file of the third respondent, which was registered for the offences punishable under Sections 406 and 420 IPC, based upon the direction issued by the learned Judicial Magistrate, Rajapalayam in Cr.M.P.No.11373 of 2019, dated 19.09.2019. After registration of the First Information Report, there is no progress 1/3

so far. The learned counsel for the petitioner would submit that the petitioner's certificates including his passport and valuable documents are available with the accused. Inspite of repeated requests, investigation has not been completed. He would also pray that a direction may be issued to the first respondent to monitor the investigation.

3.The learned Additional Public Prosecutor(Crl.side) appearing for the respondents would submit that the accused persons are residing at Chennai, due to which, the respondent police is not in a position to secure them and seek four months time to complete the investigation.

4.Recording the submission of the Additional Public Prosecutor, there shall be a direction to the third respondent to complete the investigation and file the Final Report within four months from the date of receipt of a copy of this order. Considering the facts and circumstances of the case and the request made by the learned counsel for the petitioner, further direction is issued to the first respondent herein to monitor the investigation.
