ORDER
The petitioner is before this Court seeking a direction to the first respondent to restore electricity service connection to the petitioner's unit, namely, M/s. Follow Jesus Ice Plant, situated at No.1-1-405 (Near 2/6
the Church), Eraviputhenthurai, Thoothoor Post, Kanyakumari District.
2. It is not in dispute that the Tamil Nadu Pollution Control Board, in exercise of its powers under Section 33A of the Water (Prevention and Control of Pollution) Act, 1974, had directed restoration of power supply to the petitioner's unit on a temporary basis up to 31.03.2026. Pursuant thereto, electricity supply was restored. However, upon expiry of the said period and in the absence of any further order from the Tamil Nadu Pollution Control Board extending the permission, the respondents disconnected the power supply.
3. The learned Standing Counsel appearing for respondents 3 and 4/TANGEDCO submitted that the electricity service connection can be restored only upon appropriate orders being issued by the Tamil Nadu Pollution Control Board.
4. In view of the above, this Court is not inclined to grant the relief sought for. However, liberty is granted to the petitioner to approach the Tamil Nadu Pollution Control Board seeking appropriate orders for 3/6
restoration of power supply to the unit.
5. If such a request is made, respondents 1 and 2 shall consider the same on its own merits and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of such request.
6. With the above observations, the Writ Petition stands disposed of. There shall be no order as to costs.
