The Petitioner herein seeks a direction to the respondents to measure the property in Pathway measuring 20 links in S.No. 768/1A in Dumbichipalayam Village, Kallimandayam, Ottanchathiram Taluk, Dindigul District by considering the Petitioner's online application, dated 24.02.2025 in Application No.2025/0123/13/010038.
2.Mrs.S.Jeya Priya, learned Government Advocate takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the Petitioner that the subject property is an ancestral property of the petitioner's family and in the year 1984, there was a partition among the family members on 27.3.1984. In the said partition, the subject property in S.No.768/1 has been shown as pathway. After the death of the petitioner's father, her mother has been enjoying the subject pathway. Hence a representation was submitted by the Petitioner on 24.02.2025 seeking survey of the pathway. The same has not been considered till date. Hence the Petitioner has come before this Court with the 2/5
present Writ Petition for the relief stated supra. 4.Mrs.S.Jeyapriya, learned Government Advocate who takes notice for the respondents 1 and 2 would submit that the online application submitted by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without going into the merits of the matter, the respondents are directed to consider the online application of the Petitioner, dated 24.02 .2025 and pass orders on its own merits after issuing notice to the Petitioner and neigbouring land owners one Natarajan, whose name is mentioned in the affidavit filed in support of the Writ petition, within a period of 12 weeks from the date of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
