ORDER
This writ petition is filed to direct the first respondent to expedite the proceedings of the case filed by the petitioner in No.A2/8110/2015 which is pending for the past 5 years before the first respondent.
2.Heard Mr.S.Muthukumar, learned counsel appearing for the petitioner and Mr.C.Ramesh, learned Special Government Pleader appearing for the first respondent.
3.The learned counsel appearing for the petitioner submitted that the petitioner has filed a petition in A2/8110/2015, dated 20.06.2015 before the first respondent to cancel the patta granted in favour of the second respondent. Thereafter, the second respondent has filed a counter affidavit before the firs respondent. Pursuant to which, the first respondent issued notice to the petitioner on 21.07.2020 for enquiry. On receipt of such notice, the petitioner appeared for enquiry before the first respondent and thereafter, no communication was received by the petitioner. Hence, the present writ petition has been filed.
4.The learned Special Government Pleader appearing for the first respondent submitted that the petitioner's application dated 20.06.2015 will be considered and appropriate orders will be passed https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.13307 of 2020 in accordance with law, within the time to be stipulated by this Court.
5.Considering the submissions made on either side, this Court, without expressing any opinion on the merits of the case, directs the first respondent to dispose of the petitioner's application in A2/8110/2015 dated 20.06.2015 and pass appropriate orders on its own merits and in accordance with law, after providing due opportunity to the petitioner as well as the interested parties if any, within a period of twelve weeks from the date of receipt of a copy of this order.
6.With the above direction, this Writ Petition stands disposed of. No costs.
