Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to issue patta by rectifying the mistake in respect to the extent and nature of the property comprised in New Survey No.325/22, Old Survey No.214/27A1 in S.Pudur Village, Thiruvidaimaruthur Taluk, Thanjavur District from Government Poramboke to Natham on the basis of the representation of the petitioner dated 06.04.2017.

By consent, this writ petition itself is taken up for final disposal.

2. Heard the learned Counsel on either side.

3. According to the petitioner, the property in question is his ancestral property and after some rounds of litigation, patta was issued to him, classifying the property as Government Poramboke. It is his grievance that the extent of his land was wrongly mentioned in the patta and in order to rectify the same and to re-classify the nature of the property, the petitioner has submitted a representation dated 06.04.2017 to the respondents. Since the said representation has not been considered so far, the petitioner is before this Court with the above prayer. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate appearing for the respondent would submit that if a reasonable time is granted to him, appropriate orders will be passed on the representation of the petitioner dated 06.04.2017.

5. Considering the facts and circumstance of the case and also taking into account the limited scope of the relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the matters, directs the respondent to consider the representation of the petitioner dated 06.04.2017 and pass suitable orders thereon, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner as well as other interested parties, if any.

6. With the above direction, this writ petition is disposed of. No costs.
