Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent to pass order upon petitioner representation dated 20.01.2021 and 15.04.2021 to issue the separate patta to the petitioner land in Survey No.270/14 at Valanthur Village, Usilampatti Taluk, Madurai District within a time frame fixed by this Court.

ORDER

The petitioner seeks a separate patta in respect of the property in Survey No.270/14, Valanthur Village, Usilampatti Taluk, Madurai District.

2. It is stated that patta No.826 was issued in favour of the petitioner's father as regards the property in Survey No.270/14. Subsequently, an adjacent parcel of land in survey number was sold to one Mr.Ashok Rajan by the petitioner's father under the sale deed executed in the year 2008. The petitioner seeks a separate patta so as to enable a sub division of the property as between himself and the said Mr.Ashok Rajan. It is stated that in spite of submitting multiple representations no action has been taken thereon.

3. Mr.R.Baskaran, learned counsel for the State, accept notice on behalf of both the respondents and submits that the respondents https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.13548 of 2021 may be directed to dispose of the petitioner's representation on merits.

Accordingly, without going into the merits of the matter, the second respondent is directed to consider the petitioner's representation dated 15.04.2021 for issuance of a separate patta in respect of the land in Survey No.270/14 Valanthur Village, Usilampatti Taluk, Madurai District. Such representation shall be disposed of within three months from the date of receipt of a copy of this order by a reasoned order, after providing a reasonable opportunity to the petitioner and any others who would be affected thereby, including Mr.Ashok Rajan.

5. W.P.(MD).No.13548 of 2021 is disposed of on these terms without any order as to costs.
