ORDER : The Court Made the following order :- The petitioner is in judicial custody since 22.05.2018 for the offences punishable under Sections341, 294(b), 307, 506(ii) of IPC, subsequently, the case has been altered for an alleged offence under Section 302 of IPC, in Crime No.69 of 2018 on the file of the respondent police. He seeks bail.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The case of the prosecution is that the petitioner, first accused and the deceased are friends. On 20.05.2018, there was a wordy quarrel between themselves. On such provocation, the petitioner and another attacked the deceased with Aruval. He was taken into hospital for treatment and unfortunately, the treatment failed, he died after 10 days. Hence, the complaint. 4.The learned counsel for the petitioner would submit that the petitioner was arrested and remanded judicial custody on 22.05.2018. The accused/petitioner and another had good friendship with the deceased. Due to sudden provocation, they attacked the deceased. Hence, he prays for grant of bail to the petitioner.
5. Considering the facts and circumstances of this case and considering the period of incarceration by the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the https://hcservices.ecourts.gov.in/hcservices/
petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Vilathikulam.
