Respondents PRAYER: Petition filed under Section 482 of Criminal Procedure Code, directing the Respondent Nos.1 and 2 to provide adequate police protection to the petitioner for his life and limb and to construct the cowshed in his property in Survey No.318, Sokkampatti, Ayanporuvai, Manapparai (Taluk), by taking into consideration of the petitioner's representation dated 07.07.2020, under C.S.R.No.179 of 2020, within a time frame fixed by this Court. O R D E R

This Criminal Original Petition has been filed seeking a direction to direct the respondent Nos.1 and 2 to provide adequate police protection to the petitioner for his life and limb and to construct the cowshed in his property in Survey No.318, Sokkampatti, Ayanporuvai, Manapparai (Taluk), by considering the petitioner's representation dated 07.07.2020.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 and 2.

3. Today when the petition is came up for hearing, the learned Government Advocate appearing for the respondents 1 and 2, on https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD)No.10594 of 2020 instructions, would submit that the representation dated 07.07.2020 given by the petitioner was already considered by the 2nd respondent police in C.S.R.No.179 of 2020 in which, during the time of enquiry, the respondents 3 to 5 made an undertaking before the 2nd respondent herein that they have not made any disturbance to the construction work now carried by the petitioner and thereafter, after recording the said undertaking, the enquiry was closed.

4. In this regard, the learned counsel appearing for the petitioner would submit that after giving an undertaking, again the respondents 3 to 5 creating an unpleasant situation and thereby, they violated the undertaking given by them before the 2nd respondent.

5. In this regard, learned Government Advocate (crl.side) appearing for the respondent Police undertakes that if any fresh representation is received from the petitioner, the 2nd respondent police is ready to consider the same in accordance with law.

6. Recording the said submission, this Criminal Original Petition is closed.
