Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records related to impugned proceedings dated 22.09.2025 passed by the 1st respondent in Mu.Mu.10059/2024/A3 and quash the same and consequently direct the 1st respondent to cancel the settlement deed No. 827/2021, SRO Moolakaraipatti in favour of 3rd respondent. 1/4

ORDER
Mr.P.Subbaraj, learned Special Government Pleader takes notice for the first respondent.
2.The petitioner assails the order dated 22.09.2025 passed by the first respondent in exercise of power under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Against the said order, an efficacious remedy of appeal is provided under Section 16 before the District Collector. Before exhausting the said appeal remedy, the petitioner has filed this writ petition.
3. Accordingly, the Writ Petition is disposed of preserving liberty to the petitioner to file an appeal under Section 16 of the Act within a period of four weeks from the date of receipt of a copy of this order. 2/4
4. If such an application is filed, the appellate authority/District Collector shall consider the same on merits without going to the question of limitation.
5. There shall be no order as to costs.
