Prayer : Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the 3rd respondent to take steps to attach the property immediately and keep in their custody till the action proceedings of the criminal case in Crime No. 96/2022.

ORDER

The petitioner is a victim in Crime No.96 of 2022. The case of the petitioner is that the accused in Crime No.96 of 2022 robbed 500 sovereigns of jewels from his house and this money has also been invested by the accused in a Spinning Mill. Therefore, the petitioner expects the respondent Police to take appropriate action to attach the property, which was purchased by the accused from the crime amount and also filed this writ petition seeking a Mandamus. 2/5

2. When this writ petition is taken up for hearing, the learned Additional Public Prosecutor, on instructions, submits that necessary application has already been filed by the Investigating Agency before the learned Judicial Magistrate No.I, Oddanchatram, in Crl.M.P.No.299 of 2025 under Section 105(3) Cr.P.C. He further submits that the said application has been filed before the Court on 09.04.2025 and it is listed for hearing on 10.06.2025.

3. Since it is reported that necessary steps have already been taken by the Investigating Agency by filing necessary application before the learned Judicial Magistrate No.I, Oddanchatram, this writ petition is closed with a direction to the learned Judicial Magistrate No.I, Oddanchatram, to conclude the proceedings in Crl.M.P.No.299 of 2025, within a period of two months from the date of receipt of a copy of this order. No costs.
