When the matter is taken up for hearing, the learned Government Advocate (Crl. side) appearing for the respondent police submitted that the matter has been referred as Mistake of Fact on 31.12.2016 before the learned Judicial Magistrate, Vilathikulam and RCS notice has been served on the complainant.
