For Respondent : Mr.S.S.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.211 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 174 @ 306 IPC in Crime No.211 of 2023 on the file of the respondent police seeks bail.
2. The case of the prosecution is that the first petitioner is the the father of the deceased Rajarajan and the deceased had committed suicide by hanging on 05.05.2023. The defacto complainant, who is the grand father of the deceased has given a complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioners are an innocent person and he has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that after the death of the first petitioner's wife, he had married the second petitioner and the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.8668 of 2023 first petitioner was having one son through first wife. The said son has committed suicide by hanging since the the first petitioner was refused to give the property to him. He would further submit that the investigation of the case is in initial stage and the RDO report is yet to be received.
5. Considering the facts and circumstances of the case and also considering the fact that the alleged incident was occurred only on 05.05.2023 and that the investigation of the case is in initial stage and that the RDO report is not yet to be received, this Court is not inclined to grant anticipatory bail to the petitioners.
