ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.77 of 2024, for the offence under Section 392 IPC, has filed this petition seeking anticipatory bail.

2. The petitioner herein has been arrayed as A3. The case of the prosecution is that the accused persons have committed theft of cell phone from the defacto complainant. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been falsely implicated in this case. He further submits that A1 and A2 have been released on bail and the stolen property has also been recovered. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) opposes for grant of anticipatory bail on the ground that the petitioner is having six previous cases.

5. Considering the nature of offence and also considering the antecedent of the 2/3

petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
