For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.317/2013 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused-9, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 21(1) r/w 17 of Prevention of children from Sexual Offence (POCSO) Act, 2012, in Crime No.317 of 2013 on the file of the respondent police, seeks anticipatory bail.

2.It is seen that the accused is arrayed as an accused in the above said crime and he was enlarged on bail. After investigation, charge sheet was filed and the same was numbered as Spl.S.C.No.65 of 2018. In that case, co-accused were found not guilty and they were acquitted under Section 235(1) of Cr.P.C. Because of the nonappearance of the petitioner, the case has been split up and renumbered as Spl.S.C.No.48 of 2019 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act,Sivagangai. coming back to India, warrant has been executed against him. Hence, the present petition has been filed.

3.The petitioner can very well work out his remedy before the concerned Court by surrendering and the question of anticipatory bail does not arise Since he was already released on bail. 4.With the above said liberty, this Criminal Original Petition is disposed of.
