RESPONDENT/ RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed on the Petitioners 1 and 3 in Crl O.P (MD) No.2437 of 2021 dated 09.07.2021 and permit the petitioners to execute a bond for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties each for a like sum to the satisfaction of the Learned Special Judge,(For EC & NDPS Act Cases) Madurai instead of executing sureties before learned Judicial Magistrate, Nilakottai.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.J.SELVAM, Advocate for the petitioners and of Mr.P.KOTTAICHAMY, Government Advocate(Criminal Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.(MD)No.2437 of 2021 dated 09.07.2021. 2.Learned Counsel for the petitioners submitted that this Court by order dated 09.07.2021, in Crl.O.P.(MD)No.2437 of 2021, has granted anticipatory bail to the petitioners with certain directions and one among them is to execute sureties before the learned Judicial Magistrate, Nilakottai, Dindigul. He would further submit that the offence in the case relates to NDPS Act, as such, they are triable before the learned Judge, Special Court for EC & NDPS Act cases, Madurai. CRL MP(MD) No.6552 of 2021 permit the petitioners to execute the sureties and other conditions before the learned Judge, Special Court for EC & NDPS Act cases, Madurai, instead of learned Judicial Magistrate, Nilakottai, Dindigul.
3.Heard the learned Government Advocate (Crl. Side) appearing for the respondent.
4.In view of the submissions made, this petition is ordered and the petitioners are directed to comply with the conditions and execute the sureties before the learned Judge, Special Court for EC & NDPS Act cases, Madurai. Excepting the satisfaction court, all other conditions as imposed in Crl.O.P.(MD)No.2437 of 2021, dated 09.07.2021, stand intact and the petitioners are directed to comply with the same within a period of ten days from the date of receipt of a copy of this order.
