Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned proceedings passed by the 2nd respondent vide Proc. No.2177/A3/2025-1 dated 04.03.2026 and Proc.No.2177/A3/2025-2, dated 04.03.2026 and quash the same as illegal and arbitrary and consequently to direct the 1st respondent to consider petitioner's appeal dated 31.03.2026 and to direct the second respondent to release the subsistence allowance from the month of March 2025 to March 2026 and succeeding months and to reinstate the petitioner in service within a time frame that may be stipulated by this Honble Court.

ORDER

The short grievance of the petitioner in the present writ petition is non-consideration of the appeal filed by the petitioner before the Board of Directors under Rule 5(12) of TANCEM Service Rules against the orders passed by the second respondent in Proceedings No. 2177/A3/2025-1 dated 04.03.2026.

2. According to the petitioner, the said appeal was filed on 31.03.2026. But the Board has not taken any steps for consideration of the said appeal thereby causing serious prejudice to the petitioner as he was out of employment since 27.02.2025 and seeks appropriate direction to the first respondent for consideration and disposal of the appeal.

3. From a perusal of the material on record, it is seen that the said appeal was served upon the first respondent on 1st April 2026 and now only three weeks time has elapsed. In the meanwhile, the petitioner is approaching this Court by filing the present writ petition. In the considered view of this Court, the petitioner has hurriedly 2/5

approached this Court without even waiting for a reasonable period to enable the first respondent to consider the appeal filed by him.

Be that as it may, taking into consideration of the fact that the petitioner has been out of employment since the month of February 2025, this Court is of the considered view that it would be in the interest of justice if appropriate directions are issued to the first respondent to dispose of the appeal filed by the petitioner.

5. This writ petition is disposed of at admission stage directing the first respondent to dispose of the appeal dated 31.03.2026 filed by the petitioner against the orders dated 04.03.2026 as expeditously as possible, at any rate, within a period of two months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
