O R D E R

The petitioner/ accused in CC No.41 of 2015, on the file of the Additional District Sessions Court, EC and NDPS Act Cases, Pudukottai, cases, Madurai was tried by the trial Court and he was found guilty and convicted for the offence under 8 (c) r/w 20(b) (ii)(C) of NDPS Act and sentenced to undergo 10 years rigorous imprisonment with fine of Rs.1,00,000/-, and default sentence of two years rigorous imprisonment was also imposed, if the fine amount has not been paid. Along with 1/4

this appeal, the appellant has moved an application in Crl.MP(MD) No.877 of 2017 in Crl.A(MD) No.30 of 2017, to suspend the sentence imposed on him. This Court, by its order dated 21.01.2017, has suspended the sentence till the disposal of the appeal with certain conditions. This Criminal Appeal was also admitted on 31.01.2017. This Court, by its earlier order, dated 19.03.2025, has recalled the order, granting suspension of sentence to the petitioner in Crl.MP(MD) No.877 of 2017 in Crl.A(MD) No.30 of 2017, dated 21.01.2017, considering the manner in which, the criminal appeal was prosecuted by the appellant. Therefore, he was arrested by the respondent police on 27.03.2025 and since then he is in jail.

2.The learned counsel for the petitioner submits that marriage has been arranged for the petitioner's son on 16.05.2025 and therefore, he requests for grant of suspension of sentence to him.

3.In view of the specific request made by this petitioner that his son's marriage is scheduled on 16.05.2025, this Court is inclined to grant interim bail to this petitioner with certain conditions. Accordingly, this petitioner is ordered to be released on interim bail from 05.05.2025 to 25.05.2025 with the following conditions:- i. The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of 2/4

the learned Additional District and Sessions Judge, EC and NDPS Act cases, Pudukkottai. The sureties must be of respectable persons in the Society. ii. The sureties shall file an affidavit of undertaking before the respondent police for the availability of this petitioner during the interim suspension period and also his surrender before the Central Prison, Madurai, after completion of interim bail.

iii. The petitioner shall report before the respondent police, during the interim suspension period, daily at 5.00 p.m, till 25.05.2025. iv. The petitioner shall surrender before the Central Prison, Madurai on 25.05.2025.
