ORDER

This petition is filed to cancel the bail granted in favour of the first respondent /sole accused in Crl OP(MD) No.5529/2026 dated 17.03.2026 and commit her to custody.

2. The learned counsel for the petitioner would submit that the first respondent has breached the conditions of this Court as the entire stolen articles were not produced before the Trial Court and hence, prayed to cancel the bail granted to the first respondent. He would further submit that this Court recorded that the stolen articles were recorded. However, they only recovered 6 grams of gold ornaments, even as per the FIR the stolen article is 7 1⁄2 sovereigns. Hence, he prayed to cancel the bail granted to the first respondent.

3. The learned counsel for the first respondent would submit that the petitioner has not produced any documents to prove her 2/5

contention and the first respondent was not involved in any occurrence as alleged by her. Mere pleading without any documents is not a sufficient ground to cancel the bail granted to the first respondent. Therefore, he prayed to dismiss this petition.

4. Heard both sides and perused the records.

Considering the rival submissions made by the learned counsel on both sides and considering the facts that the petitioner has not produced any document to substantiate her contention, mere allegations are not sufficient to cancel the bail already granted to the accused and as far as recovery of jewels is concerned, the accused has no role in producing the jewels before the Court, this Court is of the view that there are no grounds to cancel the bail already granted to the accused. 3/5

6. Accordingly, this Criminal Miscellaneous Petition is dismissed.
