Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents 1 to 3 to cancel the sale deed in property of the petitioner situated in purchase deed document No.1186/2020, dated 08.07.2020 at Ottanchathiram Village, Ottanchathiram Taluk, Dindigul District and appropriate action taken to the respondents 1 to 3 are acting with the intention expropriating his property based on his representation made to respondents 1 to 3 sent through Registered post on 09.09.2020 within the time limit that may be stipulated by this Court.

ORDER

The petitioner has come forward with this Writ Petition to cancel the sale deed dated 08.07.2020 bearing Document No.1186 of 2020.

2. Mr. K.Sathiyasingh, learned Additional Government Pleader takes notice for the respondents. By consent, the writ petition is taken up for disposal at the admission stage itself. In view of the order to be passed in this petition, this Court is of the view that notice need not be sent to the 4th respondent as no prejudice would be caused to her.

The learned counsel appearing for the petitioner submitted that though the sale deed has been executed on receipt of part payment, after registration the 4th respondent refused to pay balance amount and hence, the petitioner has submitted a representation, dated 09.09.2020 seeking to cancel the sale deed, dated 08.07.2020. As there was no response to the same, the petitioner has come forward with this writ petition.

4. Once the document registered is valid, the question of directing the respondents 1 to 3 to decide the representation does not arise. Further, the petitioner has no remedy before this Court and he will have to approach the appropriate forum, but, he has approached wrong forum. Hence, This Court is not inclined to grant the relief sought for by the petitioner.

5. Accordingly, this Writ Petition is dismissed. No costs.
