Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.K.SANKAR, Advocate for the petitioner and of MR.P.KOTTAI CHMAY, Additional Public Prosecutor (Criminal Side) for the respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.O.P.(MD)No.2674 of 2021 dated 15.03.2021.
2. The learned counsel appearing for the petitioner submits that the petitioner was granted anticipatory bail in Crl.O.P.(MD) No.2674 of 2021 on 15.03.2021 with a condition that the petitioner shall appear before the concerned Judicial Magistrate execute the sureties within a period of 15 days from the date of receipt of a copy of the order. Since the petitioner has not complied with the same, he moved a petition for extension of time in Crl.M.P.(MD) No.4005 of 2021. This Court, vide order 17.06.2021, granted a further time of two weeks. Thereafter, the petitioner executed sureties and started complying the condition from 14.07.2021. On 26.07.2021, when the petitioner went to the respondent Police Station along with two others, a Para-Constable insisted the petitioner and others to enter their names in the visitors' note book, for which, the petitioner raised an issue with the ParaConstable, abused her and also intimidated her. CRL MP(MD) No.5353 of 2021 in Cr.No.292 of 2021 for the offences under Sections 353 and 506(i) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.
3. In view of the subsequent involvement in yet another case and the nature of offence committed by the petitioner, this Court is not inclined to relax the condition. Accordingly, the Criminal Miscellaneous Petition is dismissed.
