Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 2nd respondent i.e., the District Collector, Sivagangai to implement the directions issued by the Joint Commissioner of Revenue Administration, Chennai in his No.R.C.Ser.5(2)/99943/2010 dated 20.06.2013 and further to implement the directions issued by the Principal Secretary and Commissioner of Revenue Administration, Chennai in his letter No.R.C.Ser.5(2)/79293/2006 dated 25.03.2017 within a specified time frame that may be fixed by this Court. ORDER

This writ petition has been filed seeking to direct the 2nd respondent to implement the recommendations of the Joint Commissioner of Revenue Administration, Chennai in R.C.Ser.5(2)/ 99943/2010 dated 20.06.2013 and further to implement the directions issued by the 1st respondent in R.C.Ser.5(2)/79293/2006 dated 25.03.2017.

2.According to the petitioner, seeking to implement certain recommendations made by the authorities with regard to his grievance for regularisation of leave period and other benefits, the petitioner is before this Court.

3.It is brought to the notice of this Court by the learned Government Advocate appearing for the respondents that subsequent to the filing of this writ petition, proceedings in Na.Ka.A.2/22072014, dated 14.03.2019 has been issued by the Revenue Divisional Officer, Devakottai, treating the unauthorised absence as any leave, eligible to the petitioner.

4.Now, the learned Counsel for the petitioner prays for a direction to the 2nd respondent to consider the petitioner's pension proposal as forwarded. Such prayer is also agreed by the learned Government Advocate appearing for the respondents. 5.In view of the above, the 2nd respondent is directed to consider the claim of the petitioner relating to pension, on merits and in accordance with law and also in the light of the proceedings referred to above, and pass appropriate orders, after affording opportunity of hearing to the petitioner, within period of eight weeks from the date of receipt of a copy of this order. 6.With the above direction, the writ petition is disposed of. No costs.
