O R D E R

This petition has been filed to direct the second respondent to provide necessary police protection to the petitioner's life and limb during the course of his usage of pathway situated in S.No.704 of 2018 connecting Pudupatti to Kannivadi Village, on the basis of the petitioner's representation, dated 23.07.2021. 2.When the matter was taken up for hearing on 02.08.2021, the learned Additional Public Prosecutor has submitted that enquiry was undertaken in CSR.No.185 of 2021 and it was came to be closed on 20.07.2021. For the purpose of circulating a copy of the Closure Report, the matter was listed on 25.08.2021 and on that day, copy of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.OP(MD).No.10361 of 2021 the Closure Report was not circulated. So, it was listed today for disposal.

3. When the matter taken up for hearing, the Closure Report was circulated. It is seen that both the parties appeared before the Enquiry Officer and gave a undertaking to the effect that they will not indulge in making any trouble with regard to the pathway. The petitioner has also given an undertaking to the effect that he will survey the land and thereafter, put up pathway. So, on that basis, undertaking given by both the parties, it came to be closed on 20.07.2021.

4. Since both the parties given an undertaking, nothing survives for further considering this petition. If any trouble is arises in future, the petitioner is at liberty to work out his remedy through appropriate proceedings.

5. In view of the above, this Criminal Original Petition is dismissed as infructuous.
