ORDER

The present writ petition has been filed to direct the respondents 1 to 4 to restrain the respondents 5 to 6 and their men from conducting temple festival independently at Sri Palavesakara Swamy Temple, Tharavilai, Kanyakumari District scheduled from 02.05.2025 to 04.05.2025 and further permit the petitioner to arrange festival with the participation of all villagers by considering petitioner's representation dated 22.04.2025.

2. According to the petitioner, the respondents 5 to 6 and their men decided to conduct temple festival independently at Sri Palavesakara Swamy Temple, Tharavilai, Kanyakumari District from 2/5

02.05.2025 to 04.05.2025. In order to permit the petitioner to arrange festival with the participation of all the villagers, he sent a representation dated 22.04.2025 and the same is pending without consideration. Hence, this petition.

3.The learned Additional Public Prosecutor appearing for the respondents would submit that they have received the representations from the petitioner and the private respondents. Both are pending for enquiry. They will conduct enquiry and take appropriate action in both the representations in accordance with law.

4.This Court heard learned counsels appearing on both sides and perused the materials available on record. 5.Considering the nature of relief sought for by the petitioner and the representations of the petitioner and the private respondents are pending for enquiry before the 2nd respondent, this Court hereby directs the 2nd respondent to consider both the representations and take appropriate action in accordance with law and after affording 3/5
