Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent not to harass the petitioners under the guise of enquiry based on the petitioners' representation dated 26.07.2021. For Petitioners : Mr.D.S.Haroon Rasheed For R1 & R2 : Mr.R.M.Anbunithi, Additional Public Prosecutor

ORDER

This petition is filed to direct the second respondent not to harass the petitioners under the guise of enquiry based on the petitioners' representation dated 26.07.2021.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by one Paulraj, enquiry in C.No.80 of 2021 was undertaken and during the course of enquiry, it came to notice that it is purely civil dispute, in respect of which, O.S.No.36 of 2021 has been filed by the opposite party, wherein, these petitioners are arrayed as defendants 7 to 9. Since civil suit is pending, the enquiry was closed.

3.The learned counsel for the petitioners would submit that the subject dispute is between the parties one and the same and by mistake, he has mentioned one Panneerselvam as complainant in this Criminal Original Petition.

Crl.O.P.(MD)No.10343 of 2021 4.It is seen that the suit has been filed for various reliefs such as declaration, cancelling of sale deed etc., It is also to be noted that due to pendency of the suit, the above said complaint has been closed. Since the complaint itself was closed, nothing survives for further consideration or direction in this petition.

5.Recording the aforesaid submission of the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of.
