Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of of Mandamus directing the respondents 1 and 2 to provide necessary police protection for the petitioner and her family members for the construction of house in property bearing Natham Survey No.1/1, New Survey No.680/2, Keelakottai Village, Aathur, Chinnalapatti, Dindigul District totally measuring about 664 sq.ft. as per the building plan approval granted by Chinnalapatti Town Panchayat.

The writ petition has been filed for a writ of Mandamus directing the respondents 1 and 2 to provide necessary police protection for the petitioner and her family members for the construction of house in property bearing Natham Survey No.1/1, New Survey No.680/2, Keelakottai Village, Aathur, Chinnalapatti, Dindigul District totally measuring about 664 sq.ft. as per the building plan approval granted by Chinnalapatti Town Panchayat.

2. Heard Mr.G.Prabhu Rajadurai, learned counsel appearing for the petitioner and Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader appearing for the respondents 1 and 2. https://hcservices.ecourts.gov.in/hcservices/

The case of the petitioner is that she had purchased a property recently on 19.01.2017 and after obtaining appropriate building permission from the authorities, she is constructing a building in a premises, which has been objected by the respondents 3 and 4. In this regard, the petitioner has given a complaint, based on which a petitioner enquiry is pending in C.S.R.No.81 of 2017 and thereafter, the same has been closed by advising the parties to approach the Civil Court.

4. However, if there is any commission of cognizable offence, liberty is given to the petitioner to approach the police seeking necessary protection.

5. With the above observation, the writ petition is closed. No costs.
