O R D E R

This Writ Petition is filed for issuance of a Writ of Mandamus, directing the respondents 4, 5 and 7 to allot one day festival to the petitioner community as like other community in the Temple festival of 'Arulmigu Baghavathy Amman' situated at Thelungapati, Porunthalur Village, Kulaithai Taluk, Karur District.

2. The case of the petitioner is that there is a Temple, namely, 'Arulmigu Baghavathy Amman' situated at Thelungapati, Porunthalur Village, Kulaithai Taluk, Karur District. The Temple is controlled by the Hindu Religious and Charitable Endowments Department. There is a festival in the Temple celebrated by the Hindu Religious and Charitable Endowments Department every year in the month of May and June. The Temple Authorities will give one day for each community to conduct Mandagapadi / Temple festival. But, till now, the respondents have not given one day Temple festival to the petitioner's community called 'Scheduled Caste Devendrakula Velalar'. In this regard, the petitioner has sent several representations to the respondents 1, 3, 4, 5 and 7. Since no action has been taken on his representations, he filed this petition.

Mr.M.Lingadurai, learned Special Government Pleader takes notice for the respondents and submits that the representations given to the District Collector have been forwarded to the Revenue Divisional Officer, Kulithalai, who has conducted enquiry. The petitioner's representation has been considered by the Revenue Divisional Officer vide

Na.Ka.No.A3/4341/2022 dated 18.06.2022 and the copy of the same has been produced before this Court.

It is seen from the records that the petitioner and his community people appeared in the enquiry and there is no purpose for conducting 107 enquiry and the respondents allowed the petitioner to enter into the Temple and conduct the festival with certain conditions. If there is any threat, the petitioner shall approach the jurisdictional Police to provide necessary protection to worship the God and conduct the festival in a peaceful manner.

5. With the above direction, this Writ Petition is disposed of. No costs.
