Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorarified mandamus, to call for the records pertaining to the notice, dated 14.10.2024, on the file of the respondent and quash the same as arbitrary and illegal and consequently to direct the respondent to remove the entry made in the encumbrance register. ORDER
Heard Mr.S.Venkatesh, for the petitioner; and Mr.R.Suresh Kumar, for the respondent.
2. The impugned order has been passed, calling upon the petitioner to pay deficit stamp duty.
3. The Sub-Registrar is not the competent authority to issue notice under Section 47A of the Indian Stamp Act. Deputy Collector of Stamps is available in Dindigul District and he alone is empowered to initiate such proceedings.
4. Leaving it open to the respondent to refer the matter under Section 47A of the Indian Stamp Act, the impugned order is quashed.
5. Writ Petition is allowed. No costs.
