For Intervener : Mr.K.SIVABALAN, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offence punishable under Section 420 of I.P.C., in Crime No.405 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused were approached the defacto complainant and offered to sell the land to an extent of 54 cents located at Amur Village, Trichy.
In which the sale deed executed between the defacto complainant and the other accused persons through registered sale deed vide Document No.2727 of 2016, dated 28.09.2016 to the tune of Rs.2,10,000/-. The allegation is that the accused Nos.2 and 3 suppressed the other two legal heirs of the property and sold the same. Thereafter, the said legal heirs filed a suit as against the defacto complainant. Hence, this complaint has been registered by the defacto complainant. 3.The learned counsel appearing for the petitioner submitted that the petitioner is a mediator, he received a commission and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.
4.Heard the learned Additional Public Prosecutor appearing for the respondent and the learned counsel for the intervenor. 5.Considering the facts and circumstances of the case the dispute is purely civil in nature, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.IV, Trichy and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
