Respondents Prayer : Petition is filed under Section 528 of BNSS to direct the learned Judicial Magistrate, Aranthangi, to return back the passport of the petitioner, which was produced in CC.No.165 of 2022, for the period of one month for renewal of VISA on the basis of the order passed by this Court in Crl.O.P(MD).No.21138 of 2013 dated 15.07.2024. ORDER

This petition has been filed to direct the learned Judicial Magistrate, Aranthangi, to return back the passport of the petitioner, which was produced in CC.No.165 of 2022, for the period of one month for renewal on the basis of the order passed by this Court in Crl.O.P(MD).No.21138 of 2013 dated 15.07.2024.

2. According to the petitioner, he is an accused in CC.No.165 of 2022 on the file of the learned Judicial Magistrate, Aranthangi. As per direction of this Court in Crl.O.P(MD).No.21138 of 2023, he surrendered his passport before the trial Court. Since his passport is about to expire in the month of May-2025, it is necessary to renew the same in order to continue his job in the same company. Hence, he wants to return back passport for renewal. Hence, this petition.

3. Heard both sides and perused the materials available on record.

4. Since the passport is required for renewal purpose, the learned Judicial Magistrate, Aranthangi, is directed to return back the passport to the petitioner and the petitioner is directed to resubmit the passport before 2/4

the trial Court, after renewal, within three months from the date of receipt of a passport from the trial Court.

5. With the above direction, this Criminal Original Petition is disposed of.
