ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order dated 13.02.2026 on the file of the third respondent and consequently direct the third respondent to grant patta to the petitioner in respect of the lands in Survey Number 429 situated in Eppodumvendrans Village, Ottapidaram Taluk, Tuticorin District, to an extent of 2.79 acres within the time frame stipulated by this Court.,
2. The petitioner is claiming right over the property comprised in Survey No.429, measuring an extent of 2.79 acres, based on the sale deed dated 10.12.2025 vide Document No.5327 of 2025. The petitioner's vendor was entitled to the property based on the gift deed dated 03.01.2025 vide Document No.45 of 2025 . The vendor's father had executed the said gift deed. The vendor's father had inherited the property through a Will dated 10.04.2017. Now, the petitioner is seeking to issue patta in respect of the subject property. However, the third respondent rejected the petitioner's application by passing one line order wherein 2/4
it has been stated as per VAO report the application is rejected.
3. This Court is of the considered opinion that the impugned order is a non-speaking order. The third respondent has not stated the reason for rejection and the said order also was passed without affording an opportunity of personal hearing to the petitioner which is a violation of the principles of natural justice. Therefore, the impugned order dated 13.02.2026 is liable to be set aside. Accordingly, the impugned order is set aside. The matter is remitted back to the third respondent for fresh consideration. The third respondent is directed to consider the petitioner's application afresh, after issuing notice to the petitioner and affording him an opportunity of personal hearing, and thereafter pass appropriate orders in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
4. With the above directions, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 03.06.2026 NCC : Yes / No Index : Yes / No Internet : Yes jbr 3/4
