PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of habeas corpus directing the respondents 1 to 3 to produce the body or person of detenu namely Jacob, S/o.R.Paulraj, aged about 27 years before this Court and set him at liberty forthwith on the basis of complaint, dated 30.01.2024 given by the petitioner before the third respondent. O R D E R

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition has been filed by the wife of the detenu seeking to produce the alleged detenu namely Jacob, S/o.Paulraj, aged about 27 years before this Court and set him at liberty.

2. The case of the petitioner is that she and the missing person were living together and thereafter, they got married on 17.09.2023 in the presence of elders and family members as per the Hindu Marriage and customs. Thereafter, she and the missing person were living at Tirupur and that the relative of her husband, who are against the marriage had taken him into illegal custody. The

petitioner had given a complaint to the respondent police. Since no action has been taken, she has filed the present habeas corpus petition.

3. The learned Additional Public Prosecutor appearing for the respondents 1 to 3 would submit that pursuant to the notice issued by this Court, the second respondent police has produced the missing person before this Court.

4. We enquired the missing person. He stated that he got married to the petitioner and due to matrimonial discord, he had left the matrimonial home and is now living with his parents at Puthendal Village, Kadaladi Taluk and he is not under illegal confinement of anybody.
