PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st respondent herein to dispose of the petitioner's appeal dated 10.04.2017 with regard to transfer of Patta in respect of his landed property of an extent of 0.34.18 Ares comprised in Survey No.550/6E1 situated at Ambathurai Village, Authoor Taluk, Dindigul District after giving opportunity to the 3rd respondent within the time stipulated by this Court and for other reliefs.

ORDER

The prayer in the Writ Petition is for issuance of a Writ of Mandamus directing the 1st respondent herein to dispose of the petitioner's appeal dated 10.04.2017 with regard to transfer of Patta in respect of his landed property of an extent of 0.34.18 Ares comprised in Survey No.550/6E1 situated at Ambathurai Village, Authoor Taluk, Dindigul District after giving opportunity to the 3rd respondent.

2.Heard Ms.K.Vidya, learned counsel appearing for the petitioner and Mr.G.Muthukannan, learned Government Advocate appearing for the respondents and perused the materials available on records.

3.The learned Counsel for the petitioner would submit that an appeal preferred by the petitioner before the first respondent, dated 10.04.2017, has not yet been disposed of. Hence the present Writ petition has been filed.

4.The learned counsel appearing for the petitioner would submit that it would suffice, if a direction is issued to the first respondent to consider the petitioner's appeal, dated 10.04.2017.

5.Considering the limited scope of prayer sought for in the Writ Petition and considering the submission of the learned counsel for the petitioner, without going into the merits of the case, this Court, directs the first respondent to dispose the appeal of the petitioner, dated 10.04.2017 and on merits and in accordance with law, after providing opportunities to all the necessary parties, within a period four months from the date of receipt of copy of this order.

6.With the above direction, this writ petition stands disposed of. No costs.
