Pleased to call for the records relating to the judgment dated 25.04.2022 made in Special Case No.18 of 2011 on the file of Special Court for Trial of Prevention of Corruption Act Cases, Tiruchirapalli and set aside the conviction and sentence imposed against the appellant/accused and allow above appeal by acquitting the accused.
Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.K.ALTHAF SHERIFF, Advocate for M/S.AJMAL ASSOICATES, Advocate for the petitioner and of MR.S.RAVI, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This Miscellaneous Petition has been filed to relax the condition imposed by this Court in Crl.M.P.(MD)No.5816 of 2022 in Crl.A.(MD)No.335 of 2022 dated 09.06.2022.
2. The learned counsel for the petitioner would submit that as per the direction of this Court, the petitioner is complying with the Conditions imposed by this Court regularly and hence he prayed to relax the condition. 3.The learned Government Advocate (Criminal Side) would submit that 2/4
petitioner is complying with the conditions imposed by this Court regularly. 4.Considering the special circumstances, that the petitioner lungs was removed and he is bedridden, the condition imposed as against the petitioner is relaxed and the petitioner is directed to report before the respondent police as and when required for interrogation.
