ORDER

Heard the learned senior counsel appearing for the writ petitioner and the learned standing counsel appearing for the respondent organization.

2. The petitioner had belatedly remitted the contribution and that led to the levy of penal damages under Section 14(b) of the Employees Provident Fund and Miscellaneous Provisions Act, 1952. Challenging the same, the present writ petition has been filed. 2/4

3. The learned senior counsel relies on the proceedings dated 15.05.2020 issued by the organisation providing for waiver for penal damages during the period of lockdown.

4. In my view, the said proceedings are clearly biding on the respondents. However, as rightly pointed out by the learned standing counsel, delay committed by the petitioner pertains not only to the lockdown period but also for the period prior thereto. Therefore, the petitioner obviously cannot take advantage of the circular dated 15.05.2020 for the period prior to 01.04.2020. The respondents shall revisit the issue in the light of their own proceedings dated 15.05.2020 and issue fresh proceedings.

5. With this liberty to the respondents to revisit the issue, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
