ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 06.04.2026 for the offences punishable under Sections 296(b), 115(2), 109, and 351(3) of BNS in Crime No.143 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to previous enmity, there was a wordy quarrel arose between the parties and that the petitioner herein attacked the defacto complainant and also abused him in filthy language.

3. The learned counsel for the petitioner submitted that the petitioner was earlier enlarged on bail with a condition to appear before the respondent police every day. Due to non-compliance with the said condition, the bail granted to him came to be cancelled. Hence, this petition came to be filed.

4. The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner had remained absconding 2/6

for a considerable period and was secured only on 06.04.2026 pursuant to the formation of a special team. He was thereafter remanded to judicial custody and has been in custody from the said date. It is submitted that the case involves an offence of attempt to murder and that the petitioner is a history-sheeter. In such circumstances, if released on bail, there is a likelihood of his absconding again. Hence, the learned Additional Public Prosecutor sought dismissal of the petition.

5. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

6. Considering the fact that the petitioner is a history-sheeter in pending trial in History Sheet No. 184 of 2018, and that as many as four criminal cases of a similar nature are pending against him, this Court is not inclined to grant bail.

7. It is also seen that he had failed to comply with the conditions imposed by this Court while granting bail earlier, which led to the cancellation of the said bail. Further, he was apprehended only on 3/6

06.04.2026 by a special team constituted for the purpose and has been remanded to custody thereafter. In view of the aforesaid circumstances, this bail petition is liable to be dismissed and is accordingly dismissed. (L V G J) 24.04.2026 Sm 4/6
