O R D E R

The Criminal Original Petition has been filed seeking a direction to direct the respondents 2 and 4 not to harass and foist false case against the petitioner's husband namely Chinnakaruppan and his family members under the guise of enquiry on the basis of the petitioner's representation dated 25.09.2020. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (crl.side) appearing for the respondents.

3.Today, when the petition is taken up for hearing, the learned Government Advocate (crl.side) appearing for the respondents, on instructions, would submit that against the husband of the petitioner, the second respondent herein initiated the proceedings under Section 3 of Railway Property Unlawful Possession Act and the same is pending on his file. Crl.O.P.(MD)No.10707 of 2020 4.In view of the above, it is made clear that as of now, the criminal case has been foisted against the husband of the petitioner. After the registration of the criminal case against the husband of the petitioner, the question of harassment does not arise. In otherwise, if any order is passed in favour of the petitioner, it would amount to interference with the investigation conducted by the second respondent.

5.With the above observation, this Criminal Original Petition is dismissed.
