O R D E R

The Petitioner herein seeks a direction to consider his representation seeking change of classification of land and issuance of patta in his name in respect of the property situated in S.No.149/11 at Poolangudi Village, Thiruverambur Taluk, Trichy District.

2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 to 4. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, his father purchased 26 ares of land in S.No.149/11 in the above mentioned village and plotted out the said property. The Petitioner's father sold six plots and remaining three plots were retained by him. Subsequently, the Petitioner's father died on 1.10.2000, leaving behind the Petitioner, mother and his three sisters as his legal heirs. According to the Petitioner, subsequent to the death of his father, patta has not been changed in his name. Therefore, the Petitioner submitted a representation before the respondents on 20.1.2025 seeking issuance of patta in his name. The said representation has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.

Though in the representation submitted to the respondents, the Petitioner claimed that originally patta stood in the name of Petitioner's father and after his death, patta has not been changed in the name of the Petitioner. He has not produced any revenue records in the name of his father. However, in the Writ Prayer, apart from seeking issuance of patta, he also sought change of classification of the land. In the representation submitted by the Petitioner, there is no reference about the classification of the subject land.

5.The learned Additional Government Pleader who takes notice for the respondents 1 to 4 would submit that the subject property is classified as ''Government Tharisu'' and therefore, the request of the Petitioner cannot be considered. 6.If the request of the Petitioner cannot be considered, then it is for the respondents to pass necessary orders and communicate the same to the Petitioner. Instead of doing so, the respondents cannot keep the representation pending without any reason. 7.In view of the same, without going into the merits of the claim made by the Petitioner, this Court is inclined to direct the first respondent to consider the representation of the Petitioner dated 20.01.2025 and pass final orders on its own merits within a period of 12 weeks from the date of receipt of a copy of this order and communicate the same to the Petitioner.

8.With the above directions, the Writ Petition stands disposed of. No costs.
