India, praying this Court to issue a Writ of Mandamus, restraining the respondents 1 to 4 from interfering with the civil dispute between the petitioner and the fifth respondent with regard to Punja Properties comprised in Survey No.120/2B, 120/4A, 120/4B, 125/6, 125/8, 132/2A, 24/1B and 76/2 pertaining to Patta No.95 measuring to an total extent of 6.80.00 Hectares situated at T.Shanmugapuram Village, Ettaiyapuram Taluk, Thoothukudi District.

ORDER

This Writ Petition has been filed to restrain the respondents 1 to 4 from interfering with the civil dispute between the petitioner and the fifth respondent with regard to Punja Properties comprised in Survey No. 120/2B, 120/4A, 120/4B, 125/6, 125/8, 132/2A, 24/1B and 76/2 pertaining to Patta No.95 measuring to an total extent of 6.80.00 Hectares situated at T.Shanmugapuram Village, Ettaiyapuram Taluk, 2/4

2.Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner would contend that the official respondents herein interfered in the civil dispute pending between the petitioner and the fifth respondent and thereby, the petitioner filed a suit and the same is pending.

3.The learned Additional Public Prosecutor appearing for the official respondents would contend that already there is civil dispute pending between the parties and thereby, the petitioner has sent a representation before the official respondents and the same was also enquired and closed. The official respondent herein have not interfered in the civil dispute. Only based on the complaint given by the fifth respondent, they enquired the petitioner.

4.Recording the above said submissions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
