ORDER

This Criminal Original Petition is filed not to harass the petitioner under the guise of enquiry, based on the complaint given by the third respondent herein.

2. When the matter is taken up for hearing, the learned Government Advocate (criminal side) appearing for the respondents 1 and 2 would submit that based upon the complaint given by the third respondent, enquiry was undertaken in C.P.No.41/ALGSC/TUT/2021 and during the course of enquiry, it was found that there is a civil dispute between the parties, based upon a sale issue. It was also undertaken by this petitioner to the effect that he will repay the amount within a period of three months. Based upon the undertaking, the complaint came to be closed on 16.02.2021. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. Since the complaint has been closed on the basis of the undertaking given by the petitioner and as well as the third respondent nothing survives, for further consideration or direction. So, the question of harassment does not exist.

4. Recording the submission made by the learned Government Advocate (criminal side) and by placing on record the closure report, this Criminal Original Petition is disposed of as infructuous.
