Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to prevent the dengue virus and protect the people of Navaneethakrishnapuram Village, Sankarankovil Taluk, Tirunelveli District from the death of causing dengue flue by forming special medical camp to provide medical care and aid. [Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to take effective steps to prevent dengue virus and protect people of Navaneethakrishnapuram Village, Sankarankovil Taluk, Tirunelveli District, by way of issuing a Writ of Mandamus. 2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for all the respondents. 3.The learned senior counsel appearing for the petitioner has contended to the effect that in and around Navaneethakrishnapuram Village, so many persons have passed away due to dengue virus. Under the said circumstances, the present Writ Petition has been filed for getting the relief sought therein.
4.The learned Additional Government Pleader appearing for the respondents has also equally contended to the effect that the wife of the petitioner has passed away due to attack of some other disease and in Navaneethakrishnapuram Village one boy by name Vasanthakumar has been attacked by dengue virus and effective treatment has been given and subsequently discharged from hospital. Further the respondents are taking effective steps so as to prevent dengue virus and the petitioner has filed this petition unnecessarily and therefore the same deserves to be dismissed. 5.Considering the nature of the relief sought in the Writ Petition and also considering the fact that the boy mentioned supra has been affected by dengue virus and subsequently discharged from hospital, this Court is inclined to pass the following order. 6.
In fine, this Writ Petition is allowed without costs. The respondents are directed to take effective steps to prevent dengue virus and protect people of Navaneethakrishnapuram Village, Sankarankovil Taluk, Tirunelveli District. Consequently, connected Miscellaneous Petition is closed.
