Prayer in CMA(MD)Nos.1401 and 1402 of 2025 : These Civil Miscellaneous Appeals filed under Section 173 of the Motor Vehicle Act praying to set aside the order made in M.C.O.P.Nos.352 and 353 of 2024 dated 30.09.2024 on the file of the Motor Accident Claims Tribunal Special Subordinate Judge, Dindigul and allow the appeals with costs. (in both the petitions) For Petitioner:

Mr.S.Pugalendhi, Advocate For Respondent: Mr.S.Micheal Heldon Kumar, Advocate COMMON ORDER The above petitions have been filed seeking orders to permit the petitioners to withdraw 50% of the deposited amount along with proportionate accrued interest and costs, which was deposited by the respondent.

2. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondent.

3. It is evident from the records that this Court in C.M.P.(MD)Nos.18690 and 18693 of 2025 vide order dated 21.11.2025 directed the respondent to deposit the entire award amount together with accrued interest and costs to the credit of M.C.O.P.Nos.352 and 353 of 2024 on the file of the Motor Accident Claims Tribunal / Special 2/3

Subordinate Court, Dindigul. In pursuance of the said direction, the respondent deposited the said amount.

4. Considering the submissions made on either side, the petitioners are permitted to withdraw 50% of the award amount with accrued interest and costs on filing necessary application before the Tribunal.

5. Accordingly, these petitions are ordered.
