ORDER : The Court Made the following order :- The petitioners/A7 and A11, who were arrested and in judicial custody since 02.08.2018 and 12.08.2018 for the offences punishable under Section 5(A) of Explosive Substance Act, 1908, in Crime No.31 of 2018, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioners and others were unlawfully found possession of 5000 detonators in 50 carton boxes. Hence the complaint.
3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case and the contraband were recovered. He would further submit that co-accused/A4 and A5 in this case were https://hcservices.ecourts.gov.in/hcservices/
already released on bail by this Court in Crl.O.P.(MD) No.14662 of 2018 on 20.08.2018.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that investigation is pending. 5.Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioners are ordered to be released on bail, subject to the following conditions; (I) each of the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Rameshwaram;
(ii) the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders.
