PRAYER :- For Bail in Crime No.163 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/A.1, who was arrested and remanded to judicial custody on 23.04.2022 for the offences punishable under Section 307 IPC, in Crime No.163 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the de-facto complainant is the son-in-law of the deceased Bommaiyan and the petitioner is the son of the deceased. Due to civil dispute between the petitioner and his father Bommaiyan, the petitioner assaulted the deceased on his head and shoulder. Therefore, the deceased was admitted in the hospital for taking treatment and subsequently, he died after six days. Hence, the complaint.
3.This is the petitioner's second bail application and the earlier petition was dismissed by this Court, dated 09.06.2022 in Crl.O.P.(MD)No.10136 of 2022.
4.When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that the petitioner has been detained under the Tamil Nadu Act 14 of 1982, vide order dated 20.06.2022 in Detention Order No.57 of 2022. CRL OP(MD). No.11347 of 2022 5.Considering the seriousness and gravity of the offence alleged and also the fact that the investigation is pending and that there is no change in circumstances, since the dismissal of the earlier petition, this Court is not inclined to grant bail to the petitioner.
