O R D E R

This petition is filed by the petitioner to direct the second respondent to grant permission and protection to conduct Cithirai temple festival at `Sri Kaliamman, Mariyamman and Bagavathiamman` temples, situated at Nanthavanapatty, Seelappadi Village, Dindigul district from 06.05.2025 to 15.05.2025.

2. The learned counsel for the petitioner would submit that the petitioner is one of the Administrators of the temple and they decided to conduct Chithirai festival from 06.05.2025 to 15.05.2025. Hence, they sent a representation to the respondents on 22.04.2025 through post, seeking police protection during the festival, but the same has not been considered. Therefore, he filed this petition. Further, the petitioner undertakes to conduct the temple festival without any law and order issue.

3. The learned Government Advocate (Crl.Side) for the respondents would submit that they received the representation of the petitioner for police protection. Regarding the administration of the temple, a suit is pending and a writ petition also filed before this Court for the same relief. Page No. 2 of 5

Hence, there is a chance to law and order issue.

This Court heard both sides and perused the records. 5.According to the petitioner, he sent a representation to the respondents to grant permission to conduct festival and to provide police protection, but the same has not been considered. According to the respondents, if permission is granted, there is a possibility of law and order issue. As far as conduct festival to worship is concerned, the permission from the police is not required and right to worship is available to every individual as per Article 25 of Constitution of India. Hence, this Court directs the second respondent to consider the petitioner's representation dated 22.04.2025 and take appropriate decision in accordance with law on or before 04.05.2025.

6. With the above said directions and observations, this Writ Petition is disposed of.
